Increasingly in certain circles the idea is growing up that ‘intellectual property is theft’. With companies being concentrated into multimedia groups, literary works being captured electronically, products being created for a mass-media culture, commercial exchange on a worldwide scale, the legitimacy of the creator's literary and artistic property is being challenged. Originally the ‘droit d'auteur’ or copyright were mainly protective rules laid down by law to regulate the author's status. The legal system of literary and artistic ownership still ensures that (...) creators receive revenue each time their works are reproduced, adapted or communicated to the public. In addition the droit d'auteur has another aspect through the existence of moral right, which establishes a personal link between author and work. It is true that moral right, which is sometimes seen as an obstacle to economic development, is almost non-existent in the systems of law recognizing copyright, which do not incorporate the same balance of interests as between the author and the company. On the other hand, in its formulation the droit d'auteur takes a more human approach and to say that intellectual property is theft would be equivalent to weakening, or even eradicating, a system that protects individual creators facing the reality of the exploitation of their work. This is why this criticism of legitimacy should, in my view, be considered in the context of a debate about the status of the author. This book has been defined around three important issues: the first sheds light on how people, in various philosophical, religious, and political contexts, understand the natural environment, and how the relationship between the environment and the body is perceived; the second focuses on the perceptions that a particular natural environment is good or bad for human health and examines the reasons behind such characterizations ; the third examines the promotion, in history, of specific practices to take advantage of the health (...) benefits, or avoid the harm, caused by certain environments and also efforts made to change environments supposed to be harmful to human health. The feeling and/or the observation that the natural environment can have effects on human health have been, and are still commonly shared throughout the world. This led us to raise the issue of the links observed and believed to exist between human beings and the natural environment in a broad chronological and geographical framework. In this investigation, we bring the reader from ancient and late imperial China to the medieval Arab world up to medieval, modern, and contemporary Europe. This book does not examine these relationships through the prism of the knowledge of our modern contemporary European experience, which, still too often, leads to the feeling of totally different worlds. Rather, it questions protagonists who, in different times and in different places, have reflected, on their own terms, on the links between environment and health and tries to obtain a better understanding of why these links took the form they did in these precise contexts. Taking regular walks when living with Parkinson’s disease has beneficial effects on movement and quality of life. Yet, patients usually show reduced physical activity compared to healthy older adults. Using auditory stimulation such as music can facilitate walking but patients vary significantly in their response. An individualized approach adapting musical tempo to patients’ gait cadence, and capitalizing on these individual differences, is likely to provide a rewarding experience, increasing motivation for walk-in PD. We aim to evaluate the observance, safety, tolerance, (...) usability, and enjoyment of a new smartphone application. It was coupled with wearable sensors and delivered individualized musical stimulation for gait auto-rehabilitation at home. Forty-five patients with PD underwent a 1-month, outdoor, uncontrolled gait rehabilitation program, using the BeatWalk application. The music tempo was being aligned in real-time to patients’ gait cadence in a way that could foster an increase up to +10% of their spontaneous cadence. Open-label evaluation was based on BeatWalk use measures, questionnaires, and a six-minute walk test. Patients used the application 78.8% of the prescribed duration and enjoyed it throughout the program. The application was considered “easy to use” by 75% of the patients. Pain, fatigue, and falls did not increase. Fear of falling decreased and quality of life improved. After the program, patients improved their gait parameters in the six-minute walk test without musical stimulation. BeatWalk is an easy to use, safe, and enjoyable musical application for individualized gait rehabilitation in PD. Sara Mills’ influential Foucauldian study of women’s travel writing, Discourses of Difference, heralded a turn from the consideration of individual female travellers as exceptions towards an analysis of the discursive pressures similarly exerted on all of them, through the awareness of normative expectations regarding the production and the reception of their writings. This article revisits panopticism in the genre by showing how travel writing reveals the intersection between the material plane and the discursive process. Through the parallel analysis of three (...) travel narratives, Anna Jameson’s Winter Studies and Summer Rambles in Canada, Isabella Bird’s A Lady’s Life in the Rocky Mountains, and Mary Kingsley’s Travels in West Africa, I show how their clothing and behaviour are enacted as signs of femininity for the benefit of their contemporaries, in texts whose diaristic form articulates the writing of the self and its exhibition to the public. I thus analyse how these travel narratives illustrate the intersection of the individual and the social in power relations and self-fashioning, and how their authors negotiate surveillance in gender performance. Modern knowledge of the grammarian Consentius’ De barbarismis et metaplasmis, a work valuable for the study of the Latin language, dates back to a relatively recent past: it was only in 1817 that its editio princeps was published by Ph.C. Buttmann, just a few years after the legal scholar A.W. Cramer came across a mention of the then unknown treatise in a ninth-century MS in the Bayerische Staatsbibliothek of Munich, numbered Clm 14666. Based on this solitary manuscript, H. Keil published (...) the short treatise in the fifth volume of his Grammatici Latini. With no little enthusiasm did W.M. Lindsay announce his unearthing of what, in his own words, had ‘long been a “desideratum”, a second authority’ for this text, in the MS F 15 III d at the Universitätsbibliothek Basel; this was followed by E.O. Winstedt's complete collation and M. Niedermann's critical edition. After about a century now there comes to light a third authority, surprisingly enough in a codex which has enjoyed such fame in the past decades that one might wonder how Consentius could have gone unnoticed in it for so long: this is the eleventh-century MS of Venice, Biblioteca Nazionale Marciana Lat. Z. 497, in which the De barbarismis et metaplasmis is contained on fols. 84vb 39 - 90va 39; moreover, a so-far-unnoticed quotation from it, together with one from Consentius’ De nomine et uerbo, is found on fol. 41vb 16–21 of the same manuscript in a famous grammatical florilegium. The codex, written in Romanesque minuscule and probably originating in Rome, is regarded as a handbook of liberal arts designed by Lawrence Archbishop of Amalfi, formerly a monk at Montecassino, thereafter a teacher in Florence and Rome, where he died in about 1049. Based on palaeographical evidence, F.L. Newton rightfully assumed as an exemplar for this codex a MS in Beneventan script, as some features can be detected that betray the scribal imitation of that typical South Italian script, namely the use of the distinctive abbreviation for eius as ‘ei in ligature with stroke through the descender of the i’, the Beneventan ti ligature for the assibilated sound, and the 2-shaped Beneventan interrogation sign, to which I would add the typical abbreviation for in as a long i cut by a horizontal stroke and the confusion of a and t. Interestingly enough, none of these features is found on fols. 66–95, those containing the new Consentius: from a codicological point of view, this is an autonomous section, written by a different scribe from the rest of the MS and preserving some grammatical texts generally attributed to insular authors, such as Smaragdus’ Liber in partibus Donati and part of the compilation entitled Pauca de barbarismo, which precedes the De barbarismis et metaplasmis; not surprisingly, the new text of Consentius displays numerous features of the Insular script, such as the symbols for enim, autem, eius, est, nihil and et. On this basis it is most likely that this whole section was never included in the Beneventan exemplar, but was added at the time and place of copying of our MS in order to enrich the grammatical content. Towards the end of the Byzantine Empire many texts of the Latin Fathers were translated into Greek, beginning with the De Trinitate of Augustine. This flurry of translation spurred discussion on the authority of the Fathers. The Greeks were now confronted with the problem of what one should do when the (presumably infallible) Fathers justify apparent heresy (the Filioque)? This question became crucial after the Council of Florence and the fall of the Byzantine Empire. What is the definition of (...) a Father? A saint? A disciple? This paper forms part of a wider study examining the history and sociology of nursing education in England between 1860 and 1948. It argues that the question of whether nursing was an art, science and/or social science has been at die ‘heart’ of a wider debate on die occupational status and disciplinary identity of nursing. The view that nursing was essentially an art and a ‘calling’, was championed by Florence Nightingale. Ethel Bedford Fenwick and her allies insisted that nursing, (...) like other professions, was a ‘scientific’ and technical enterprise. Social scientists later came to challenge nursing's claim to professionalism by analysing nursing work first within die context of industrial psychology. But they also advocated a rapprochement between nursing, health services and social science research, a challenge which we are in nursing, still striving to meet This paper argues for a strong coalition of nursing with its former nineteenth century ally, social science, in die continuing struggle for change within nursing and health care policy. Rather than searching for some rarified and purified essence of nursing knowledge, it argues that nurses need to join forces with sociologists and economists in striving to shape die agenda for health services research and provide die evidential basis for health policy transformation more generally. La relation qu’entretient Leonardo Bruni à sa ville d’adoption, Florence, tant comme lettré humaniste que comme personnalité politique, est complexe. Elle constitue une « entrée » pertinente pour s’interroger sur le statut moral de la richesse privée à Florence au début du xve siècle. Peut-on être riche et bon citoyen ? En s’interrogeant sur les motivations qu’avait Leonardo Bruni en offrant une nouvelle traduction du traité pseudo-aristotélicien l’Économique à Cosimo de Médicis, on comprend que ce geste s’inscrit dans (...) un débat vivace, marqué par des prises de position théologiques et séculières initialement favorables à la pauvreté, mais aussi par une évolution de la relation entre l’Église et les marchands à Florence. En rupture avec toute idéalisation morale de la vie à la campagne, Bruni avance que la recherche privée de la richesse n’est pas nécessairement un vice. Il entend en proposer la démonstration à travers la peinture d’un homme qui réalise ses vertus dans la cité, en prônant par l’exemple une vie dans l’aisance et en contribuant à la prospérité et à la puissance de la cité. In the period following the Second World War Giulio Preti was one of the leading exponents of Italian philosophy. A master of open critical thought, cultivated in the light of a rationalism that dialogued with, and integrated into his own philosophical model, many of the currents and stances of the global research scenario. Phenomenology, Marxism, pragmatism, neopositivism, transcendentalism and structuralism: in Preti all of these found an organic and original synthesis. Further, his particular brand of rationalist-critical thought touched on many (...) aspects of philosophical knowledge: theoretical philosophy, the philosophy of science, that of language and that of art, from ethics to politics and even taking in the history of philosophy, offering authoritative contributions in every sphere. One hundred years after his birth, the University of Florence and the heir to the Faculty in which he lectured at length, the Faculty of Education, has decided to honour his memory with this anthology of studies, penned by former pupils and others and also by younger scholars, to once again focus the wealth of this thought and its, in many respects, current relevance. Even now, this particular brand of open, critical rationalism can offer a benchmark for addressing the new issues for philosophical reflection thrown up by modern society and culture. (shrink)

Pierre des Noyers, secretary of Queen of Poland Louise-Marie Gonzaga, is known for his role as a messenger, envoy, court journalist and sometimes propagandist. His work as an unofficial diplomat for the Queen and ambassador for France is less famous though no less interesting. Even though he was already quite involved in these time-consuming tasks, Pierre des Noyers also acted as a scientific intermediary for the quite curious Queen Louise-Marie of Poland. He maintained contacts with many scholars from (...) France and Italy. He could nurture this network thanks to his position as an informal diplomat at the court of the Queen and his dedication to science in general. Even by discarding his most official and political letters, his known correspondence amounts to several hundred letters written in a period of around 50 years to various friends and scholars. Roberval, Gassendi, Boulliau, Hevelius or Pascal are among these contacts and he plays for most of them the role of a scientific intermediary sharing with them observations, books and anecdotes. His letters are filled with astronomical observations, prodigies and prophecies. Des Noyers was also a practitioner of science. Having possessed a rather large collection of scientific instruments he always sought the improved ones and his daily life was marked by scientific studies. He wrote meteorological bulletins for Academia del Cimento in Florence, studied the measurement of time, observed the sun and showed interest in the inner workings of the human body. This article will delve further into more scientific aspects of Pierre des Noyers’s life, both at the court of Louise-Marie and outside. The first part presents a rough overview of the secretary’s contacts in the scientific environment of 17th Century France and how they were used to connect scholars from Poland with this environment. The second part of this work presents Pierre des Noyers’s practice of science as a tool to understand the world and for which utmost diligence in measurement and practice is required. The last part focuses on des Noyers’s application of this scientific method in two, now pseudo-scientific fields: astrology and divination. (shrink)

The Ruše school plays, which are described in the Latin chronicle of Jožef Avguštin Meznerič titled Notata Rastensia antiquissimis documentis desumpta et variis fide humana dignis autographis syno­ptice descripta in connection with the Latin school (1645–1760), are frequently seen as an early attempt of theatrical production, lost in Slovenian literary history. They were introduced by the remarkable Luka Jamnik, a local priest and talented impresario, called the “Ro­mulus of Ruše” in the chronicle. In 1680, he began organizing annual plays modelled (...) after Jesuit school “comedies” (actio comica). Regular annual performances in honour of the Virgin Mary took place every early September, on the feast of Mary’s name, until 1722, but due to a later fire, no texts have been preserved. This article undertakes a unique task – the first attempt to reconstruct one of the performances from that time, a lost play from 1706 with a supposedly ancient motif about Emperor Jovinian who was miraculously led to conversion, De Joviniano imperatore mire correcto. It outlines the dramatic plot based on two literary sources, one from the Gesta Romanorum collection and the other from the Summa Theologica by a Dominican writer called Antoninus of Florence. With a collection of six periochae, “theater programs” preserved from similar school performances of the time, it also sketches the Erwartungshorizont of possible variations, just as they were presented on different European stages at the time. Furthermore, the paper presents the treatment of this motif, known as ATU 757, “The Emperor’s Haughtiness Punished,” in a series of other traditions, starting from its roots in the biblical story of King Nebu­chadnezzar (Dan 3:31–4:34) through the authors such as Herrand of Wildonie, Geoffrey Chaucer, Hans Sachs, William Morris, and Henry Wadsworth Longfellow, to the contemporary 20th-century opera by Josef Tal and Israel Eliraz. In this light, the 1706 performance in Ruše emerges as a significant annual highlight of cultural life in the region, with young intellectuals introducing their audience of several thousand viewers to a complex motif from European literary tradition that was both spiritually and socially provocative. Taking as its starting point Carr's view that historical narrative reflects the preoccupations of the time in which it is written and Foucault's concept of consensual historical discourse as the outcome of a social struggle in which the victor suppresses or at least diminishes contrary versions of historical events in favour of their own, this paper traces and discusses the historical narrative of British nursing in the Crimean war and, in particular, three competing narratives that have arisen in the latter (...) half of the 20th century and the first decade of the 21st. These are the established narrative surrounding Florence Nightingale, the new narrative surrounding Mary Seacole and an Irish narrative surrounding the role of the Sisters of Mercy. It is argued that the increased vehemence of the debate surrounding these narratives is representative of the changes that have taken place in British society. However, we also argue that the Irish narrative and its critique are reflective of deep‐rooted Anglo‐Protestant attitudes articulated by Nightingale and uncritically accepted by subsequent historians even in modern British historiography. Diplomat, bureaucrat, and practical politician, Niccolò Machiavelli served as Second Secretary to the Republic of Florence in the early sixteenth century and became the first major political thinker in the western tradition to make a complete break with the Aristotelian model of politics as a branch of ethics. While _The Prince _is his most famous work, grounding his reputation as the progenitor of "Realpolitik," his many other writings have contributed to a more complex and broader image of the man (...) and his political thought. Thus in recent years Machiavelli has come to be seen as a republican and a proto-liberal by some mainstream political theorists, and as an obfuscator of traditional values and ideologies, including gender roles, by feminists and non-feminists alike. The contributors to this volume, grappling with questions about the position of women in political society, investigate whether or not Machiavelli was truly a misogynist and a proto-fascist or instead a proto-feminist and a democratic republican. Among the themes they explore are the implications of such dichotomies as _Fortuna_ and _virtù_, the public and the private, nature and reason, ends and means, functionality and the common good, as well as the importance of the military to the socialization of citizens, particularly women, to civic life, and the social construction of gender. Mary Shepherd's An Essay upon the Relation of Cause and Effect, first published in 1824, was a pioneering work in metaphysics and epistemology. Together with her 1827 Essays on the Perception of an External Universe, they make her one of the most important philosophers of her era. Although widely neglected by the history of philosophy in the decades after her death, her works have recently begun to attract the attention and sustained study they deserve. Shepherd offers trenchant and detailed rebuttals of the arguments and conclusions of many prominent predecessors-including George Berkeley, Thomas Reid, Dugald Stewart, Thomas Brown, William Lawrence, and especially David Hume-but she is no merely negative thinker. This is the first modern edition of the works of Lady Mary Shepherd, one of the most important women philosophers of the early modern period. Shepherd has been widely neglected in the history of philosophy, but her work engaged with the dominant philosophers of the time - among them Hume, Berkeley, and Reid. In particular, her 1827 volume Essays on the Perception of an External Universe outlines a theory of causation, perception, and knowledge which Shepherd presents as an alternative to (...) what she sees as the mistaken views of Berkeley and Hume. What she ultimately presents is an original and systematic metaphysics and epistemology. Shepherd's Essays consists of two parts. The first is a theory of perception and knowledge of the external world, which is designed to rebut idealism and skepticism about the external world and show that our ordinary beliefs are based on reason. The second is a collection of essays on topics in metaphysics and epistemology, including the immateriality and eternity of the mind, the relationship between mind and body, the possibility of miracles, the association of ideas, the relationship between physical and mathematical reasoning, and the epistemology of testimony. This paper identifies, develops, and argues for an interpretation of Mary Astell’s understanding of self-government. On this interpretation, what is essential to self-government, according to Astell, is an agent’s responsiveness to her own reasoning. The paper identifies two aspects of her theory of self-government: an ‘authenticity’ criterion of what makes our motives our own and an account of the capacities required for responsiveness to our own reasoning. The authenticity criterion states that when our motives arise from some external source without (...) validation by our own understanding of the reasons supporting them, then they are not our own. The capacities requisite for responsiveness to our own reasoning are those of examining and evaluating our own motives and of resisting the social pressure to conform to others’ opinions. An upshot of this interpretation of Astell’s theory of self-government is that it reveals her insights into the ways ‘custom’ can undermine an individual’s ability to govern oneself. (shrink)

Cette boucle opérée dans l?exposition est certes caractéristique de la mise en ?uvre d?une rationalité dialectique, mais elle témoigne aussi de l?importance que Sartre accorde à la vie dans le déploiement de celle-ci.
